Official Rules For Haus Labs By Lady Gaga TikTok Hashtag Challenge Campaign Giveaway

Overview:

HLB90067, Inc. (“Company”) of El Segundo, California is the global distributor of the Haus Laboratories branded beauty line, and is giving 1 person a chance to win a $1000 Sephora Gift Card through our #hauslabsfoundation TikTok Challenge.. One (1) winner will be selected at random. The entry period will begin at 6AM PDT September 27th and end midnight, PDT, October 3rd 2022, and Company will promptly announce (1) winner after that on the @hauslabs account. Winner must be following @hauslabs on TikTok and will be notified via TikTok comment and Direct Message to claim his/her prize.

No purchase is required in order to win a prize, and should you make any purchase this will not improve your chances of winning. This is not a lottery or skill contest.

This Giveaway is subject to all applicable governmental laws and regulations, and is void where prohibited by law.

Eligibility.

To be eligible the Giveaway entrant may only reside in the US, must be 18 years of age or older, must upload a TikTok video using the official campaign sound and include #hauslabsfoundation in caption, and must feature Triclone Skin Tech Foundation in video. Timeliness of each entry will be determined by the time stamp of the entrant’s transmission or upload of the entrant’s TikTok video, provided it meets all eligibility requirements. Eligibility shall be determined in Company’s sole discretion.

Employees of the Company and their immediate family members are not eligible to participate in the Giveaway.

Entry Requirements.

The Contest entry time period is between 6:00 a.m., PDT, September 27th 2022 and midnight, PDT, October 3rd 2022. During this time Company will post Campaign details on TikTok’s app and promote contests on TikTok account @hauslabs by Company’s TikTok posts.

To enter, during this Contest entry time period, the entrant must post at least one TikTok video using the official campaign sound and include #hauslabsfoundation in caption, and feature Triclone Skin Tech Foundation in video.

If any entrant shares TikTok across other social platforms, then such entrant will receive a bonus entry in this contest.

By making an entry each entrant confirms that each entrant meets all eligibility requirements and has read these Official Rules, and confirms that when they accept the prize they agree to the release of their personal rights of publicity to be used by Haus Labs in association with the announcements of winners in the Giveaway.

Prizes.

There will be 1 winner selected randomly from the pool of eligible entries by use of customary sweepstake randomizer algorithmic software. 1 winner selected will receive a Sephora Gift Card valued at $1,000. The prize is restricted to the Winner’s use only, and is not transferable. The estimated retail prize value per Winner is $1000 (Sephora Gift Card). No prize shall be substituted for cash. The Company is presently unable to estimate the odds of winning a prize as the odds will be based on the number of valid entries. For example if there are 100,000 valid entries, then the odds of winning per entry are 1/100,000 or .001%.

Should any Winner not respond to Company within 12 hours of the notification of winning, then Company may in its sole discretion choose to replace that winner by the selection of another winner at random.

Release of TikTok

By entrant’s entry into this Giveaway each entrant acknowledges that this Giveaway is in no way sponsored, endorsed or administered by, or associated with TikTok, and each entrant releases TikTok from any liability arising out of the Giveaway.

California Consumer Privacy Act (CCPA) Compliance

Rights of Publicity Release

Each winner hereby agrees by his/her entry to a full release of all of his/her personal rights of publicity in his/her name, likeness, image, voice, and photographs in connection with the Giveaway. The contract terms for this will be as follows.

GIVEAWAY WINNER CONSENT AND RELEASE

In connection with the entry into, administration of, related prior and subsequent publicity, and promotion of the “#hauslabsfoundation TikTok Challenge Giveaway” for good and sufficient consideration, receipt of which is hereby acknowledged, I, the undersigned (“Winner”), hereby give irrevocable unrestricted permission, in perpetuity (except for residents of Tennessee where it will be for five years, or as otherwise restricted by law), throughout the world and for all time to HLB90067, Inc. of El Segundo, California (“HLB”), its parent, subsidiaries and affiliates, and each of their respective officers, directors, shareholders, employees, agents, representatives, successors, licensees, advertising agencies, and assigns (the “Released Parties”):

• to take, copy, use, distribute, display, perform, reuse, publish, and republish any photograph, likeness, image, voice, and name (collectively “Rights of Publicity”) of Winner, in whole or in part, for any commercial or non-commercial use in any and all media now or hereafter known, including but not limited to use on the internet, television, film, over the air or cable broadcast, social media, webcast, stream, download, print, CD, display, performance, advertising, commercials, trade, or any other purpose whatsoever;
• to alter or edit the Rights of Publicity, whether by blurring, distortion, alteration, optical illusion, or use in composite form without restriction as to changes or alterations from time to time;
• to any use in conjunction with such Rights of Publicity including but not limited to the use of digital compositing or distortion, and any changes or alterations color, size, shape, perspective, context, foreground or background.

Winner hereby waives any right that Winner may have to inspect or approve prior to, during, or after any usage by the Released Parties in any and all media now or hereafter known, including but not limited to use on the internet, television, film, over the air or cable broadcast, social media, webcast, stream, download, print, CD, display, performance, advertising, commercials, trade, or any other purpose whatsoever.

Winner hereby releases the Released Parties from all claims and liability of any kind whatsoever, arising out of or related to, the exercise of any of the rights granted to Company above, including, without limitation, those relating to or comprising copyright, rights of privacy, rights of publicity, or any other of my personal or property right.

Termination of Giveaway and Entries: Company reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in Company’s sole discretion) a virus, bug, non-authorized human intervention, fraud or other cause beyond Company’s control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. Company reserves the right at its sole discretion to disqualify any entry which is the result of tampering or attempt to tamper with the entry process or the operation of the Giveaway or associated websites. Company has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Company reserves the right to seek damages from any such person to the fullest extent permitted by law.

Limitation of Liability: By entering each entrant agrees to release and hold Company and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) participation in the Giveaway and/or acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process and the prize process; and (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries.

Disputes: Should any entrant have any dispute/claim regarding this Giveaway, each entrant agrees to first address it to Company at support@hauslabs.com. Should the parties be unable to resolve it within 3 months, then entrant and Company shall submit such claim/dispute only before a JAMS arbitrator in Los Angeles County brought for final resolution, and shall be governed by the laws of the State of California, as applicable. The parties agree that each shall waive all rights to a trial before a judge or jury in any other tribunal or court on the dispute/claim. In such a proceeding all parties agree to waive all claims to punitive, incidental, or consequential damages. All parties shall bear their own costs and fees incurred in this proceeding, and in any proceeding incidental to this proceeding (such as a request for a preliminary injunction before a court.) Each entrant also agrees that by participating in this Giveaway the entrant will not act as a class representative in a class action, or participate in any class action relating to this Giveaway.
